No, people have been prosecuted in the US for producing NN content. My understanding is that any photographic/videographic material can be labelled CP if a judge is persuaded by the prosecution that it fits the definition. There have been times people have been arrested for artistic materials and the judge ruled that it wasn't CP though.

It's (probably) illegal everywhere that actual CP is illegal, even Japan. That's the sole reason CandyDoll shut down. It had been legal until Japanese law was amended. Moecco is still in print, the newer junior idol gravure being a lot lot tamer than it used to be, though I would think it still fits the revised definition of CP. So I think it's just not being strictly enforced.
