the test is generally kind of shitty and there are a lot of images that historically would not have fallen afoul of obscenity charges that might fail the test
as a side note, it really is some shit - obscenity shouldn't exist as a concept (a CP ruling is independent of an obscenity one too, so you can remove the concept without stopping the law's ability to prosecute CP) and the Dost criteria are basically just the judicial system acting legislatively
