It's actually legally impossible for them to do that, and I can't find any source that they've sued Kondo, or anyone for that matter.
About a decade ago, CFM worked with an organization called Creative Commons. Under their agreement, they released Miku (and the other Crypton characters) under the Creative Commons Non-Commercial license. This license grants the right to do whatever you want, so long it as it is non-commercial and attribution is given. Importantly, this is a binding and irrevocable agreement. There's no way they could sue anyone even if they wanted to.
